Not this weekend Turk. Too many grandchildren obligations to get away. But Mrs. GOUNU II and I will be up before long. Maybe for the Minny game.
I read the decision. Could have gone either way, depending on the Judge's disposition toward enforcing the almost universally accepted finality of collectively bargained arbitration processes/results. This judge obviously latched onto some rare exceptions that have been occassionally recognized. And if his opinion contains all the relevant facts ( an assumption nobody should ever make the mistake of making ), it sounds like the League could have/should have done some procedural things differently. If I were a betting man, I would go with the League succeeding on appeal. There is a reason they beat the NFLPA to the courthouse in filing their confirmation request ( before the PA filed their complaint to oveturn Roger'sdecision ). First in time dictates the court ( and Court of Appeals) to hear the case. And my hunch is that the Court of Appeals weighed more heavily in their decision making deliberations.
Interesting bro.
Never turn to a judge to apply the law when there are other paths, it seems to me. This judge interpreted fairness instead of applying the CBA, yes?
That said, the politics are interesting and if the NFL wanted the appeal court then it will get more interesting.
Hopefully the appeal issue is handled after the season otherwise couldnt brady be suspended in more important games?
