But because we have this situation because California wanted to impose its own rules on the rest of the states (as we have now), I think there's a federal case to make that California overstepped its bounds with regards to the Interstate Commerce Clause and the federal government is empowered to step in and regulate.

He might have the authority for an executive order if Congress has already delegated some power to the executive, perhaps under the authority of the Department of Commerce or Department of Labor. I'm not a lawyer and I don't know what authority has already been delegated to the executive on this matter.
